“MusicSamplePacks” hereinafter referred to as ‘MSP’ or "We" or "Us"

1. License

MSP is the owner or licensee of the sounds. By paying for a product and downloading sounds, you grant MSP or third parties the non-exclusive right to include those sounds in your productions, websites, video games or other media productions without paying any additional royalties, license fees or other compensation.

You may not distribute, sell, rent, lease, sub-license, assign or otherwise transfer the sounds unless they are included in a fully mixed music production. You may not distribute the sounds in native format or any format that could be construed as competitive. This license expressly prohibits the resale, relicensing or other distribution of these sounds as they exist or modified in any way. You may not sell, lend, loan, rent, lease, assign or transfer all or any of the enclosed sounds to another user or for use in any competitive product. For DAW Templates, you may not publish and/or distribute the original track on which the template is based as your original track.

Demo tracks and songs are made to showcase and advertise the content of each product and do not belong to the buyer and therefore cannot be published.

2. Ownership

You will not disclose to any other party any access links or codes or passwords used to access any area of the MSP website and will keep such codes or words confidential. You will exercise due care over all audio you receive from MSP and maintain strict security measures to prevent its unauthorized use or distribution. MSP reserves the right to ban, without notice or refund, members who post MSP audios, download links, usernames, passwords or links to any newsgroups, message boards, public or private mailing lists, websites or forums, and to remove any username and/or password. If you become aware of any unauthorized use or distribution of the sounds, you must notify MSP immediately via our contact form or via email info@musicsamplepacks.com

3. User Content

You shall indemnify, defend, hold harmless and hold MSP harmless from and against any and all claims, suits, damages, liabilities and all reasonable expenses, including attorneys' fees, that MSP may incur with respect to any matter arising out of any breach of this Agreement by you.

You acknowledge that MSP has ownership rights over the audios available on this website and that any use by you that is intended to defeat the purpose of this agreement, including but not limited to selling, renting or otherwise distributing the audios, will irreparably harm MSP in a way that cannot be adequately compensated by damages. You agree that in the event of such improper use, MSP shall be entitled to an immediate injunction without the obligation to post a bond.

4. Fees and Purchase Terms

MSP reserves the right to change the site content and product prices without prior notice. The prices displayed in the shopping cart are not guaranteed. For example, if there is a special discount when you put an item in your shopping cart but it expires before your order is completed, the prices may have changed in the meantime. You should check the duration of the discount on the product page, the final price on the checkout page and the balance on your card at checkout. This is the sole responsibility of the customer/buyer.

5. Security and Registration

You do not need to be registered with the MSP to view the website, but you do need to provide certain information such as a first name, last name, a valid email address, country and address to download products. Please also read our Privacy Policy for more information. This information will only be used by us and we will not provide your personal information to any third party for direct marketing or any other purpose. We will retain all personal information you provide.

You agree that from time to time the MSP will email you about our services and related product information about loops and samples or audio production. MSP will not disclose your email address to any company outside of our organization.

6. Disclaimer of Warranties

MSP expressly disclaims all warranties or conditions of any kind, express or implied, including, but not limited to, the implied warranties of title, non-infringement, merchantability and fitness for a particular purpose.

7. Cancellation and Refund

Due to the nature of downloadable products, no cancellation or refund is possible after the purchase has been completed. Please read our "Store Refund Policy" for more detailed information.

8. Limitation of Liability

MSP does not guarantee the uninterrupted and error-free operation of the website. The Company is not liable for any direct or indirect damages that may arise from the use of the website.

9. Changes

MSP has the right to amend this Agreement at any time. Amendments shall be effective as of the date they are published on the website.

10. Applicable Law and Competent Court

This Agreement is subject to the laws of the Türkiye Cumhuriyeti (Republic of Türkiye). İstanbul Courts are authorized to settle any disputes arising out of this Agreement.
